Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Lunova AI Trading website and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

Subscription and Payment Terms

Subscription Plans

We offer various subscription plans with different features and pricing. By subscribing to a paid plan, you agree to pay the subscription fees as described on our Pricing page. All fees are in USD unless otherwise stated.

Free Trial

We may offer a free trial period for new subscribers. If you do not cancel your subscription before the end of the free trial period, you will be automatically charged the applicable subscription fee. You may cancel your free trial at any time before the trial period ends to avoid being charged.

Billing and Renewal

Subscription fees are billed in advance on a recurring basis (quarterly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You authorize us to charge your payment method on file for the renewal fee.

Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information on our servers. By providing your payment information, you agree to Stripe's terms and conditions.

Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard. Upon cancellation, you will continue to have access to the Service until the end of your current billing period. We do not provide refunds for partial subscription periods, except as required by law.

Price Changes

We reserve the right to change our subscription fees at any time. We will provide you with reasonable notice of any price changes. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Impersonate or attempt to impersonate another user, person, or entity
• Engage in any conduct that restricts or inhibits anyone's use of the Service

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Service
• Remove any copyright, trademark, or other proprietary notices from the Service
• Use any content from the Service for commercial purposes without our prior written consent
• Reverse engineer, decompile, or disassemble any software used in the Service

Limitation of Liability

To the fullest extent permitted by applicable law, Lunova AI Trading, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Investment losses or financial damages resulting from your use of the Service

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid us in the twelve (12) months prior to the claim.

Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Australia, and you hereby consent to personal jurisdiction and venue therein.

Dispute Resolution

If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting us. If we are unable to resolve the dispute within 30 days, either party may pursue formal dispute resolution.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms constitute the entire agreement between you and Lunova AI Trading regarding the use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the Service.
